Shoe usage

1.) Within twelve (12) months from the date of purchase, if any

If you notice any abnormality or defect with the shoes, please contact us without delay.

It is of course not advisable to continue using the defective/defective/objectionable product, as the distributor is not obliged to compensate for the damage caused by this. If the origin and nature of the defect, and thus the legitimacy of the complaint, are unclear or disputed between the parties, OnSize Kft. will request an independent expert opinion at its own expense to resolve the dispute, if it is legally obliged to do so.

2.) In case of doubt or dispute beyond twelve months from the date of purchase, until the end of the 2-year period, the Customer may prove at his own expense (e.g. by means of an expert opinion) that the cause of the defect was already present in the product at the time of sale (production). If the expert opinion deems the Customer's complaint to be well-founded and OnSize Kft. accepts it, we will reimburse the cost of the inspection in addition to the purchase price of the shoes.

In the event of a quality complaint, the Customer may request the repair or replacement of the product at their choice, however, if the fulfillment of the claim is impossible or would cause the company disproportionate additional costs compared to the fulfillment of the other claim, then, considering all the circumstances of the case (including the value represented in a flawless condition and the severity of the breach of contract), the company may choose repair instead of replacement. If the store has not undertaken the repair or replacement, or cannot meet the Customer's claim within a reasonable time, the Customer may (after consultation with OnSize Kft.) repair or have the defective product repaired at the expense of OnSize Kft.

However, it is important to note that OnSize Ltd. is not liable for damage resulting from unprofessional repairs.

The Buyer may - at his/her choice - request a proportional price reduction or withdraw from the contract, i.e. request a refund of the purchase price of the product, if:

  • the store did not undertake the repair/replacement or was unable to perform it, or if the entitled party's interest in the repair/replacement has ceased, then
  • a repeated performance error occurred, despite OnSize Ltd.'s attempts to repair the product;
  • the product defect is of such severity that it justifies
  • OnSize Ltd. has not undertaken to make the goods conform to the contract, or it is obvious from the circumstances that it will not repair or replace the product within a reasonable time limit or without significant harm to the buyer.

There is no right to cancel in the event of a minor error.

The following are considered defects resulting from improper use:

  • error caused by incorrect size selection,
  • in case of a defect resulting from improper handling or storage,
  • in the event of damage or failure caused by violent external influences (physical, chemical, etc.),
  • the fault has worsened or is likely to worsen as a result of unprofessional/home repair
  • its cause, origin, and extent can no longer be judged,
  • defects in laced footwear caused by improper lacing or tying,
  • result of getting wet (unless the footwear has a waterproof midsole).

The Buyer's warranty claim expires within one year from the date of purchase (performance). If the Buyer is a consumer, the limitation period is 2 years from the date of purchase (performance). The part of the repair time during which the Buyer cannot use the product as intended is not included in the limitation period.The warranty period for the part of the product affected by the replacement or repair begins anew. This also applies if a new defect arises as a result of the repair.

When a product returns to our store for repair or quality inspection, our staff will notify our Customer by phone, text message, or in writing.

Please return the shoes in a clean, dry condition in case of a complaint, to help our staff in their work, to correctly determine the origin of the defect, and to prove that the product was handled as intended.
